Florida Enacts Tough New Laws Targeting Sexual Offenses and Child Exploitation
Florida has implemented a series of tough new laws, effective today, October 1, 2025, targeting sexual offenses and child exploitation. The state legislature has enacted measures covering 30 topics, including significant enhancements to penalties for sexual image distribution and child trafficking.
Among the notable changes, creating, possessing, or sharing AI-generated sexual images or videos without consent is now a felony. The law also strengthens penalties for distributing or publishing sexual images of another person without their consent. Additionally, possessing, soliciting, or exchanging such images of children under 16 now carries felony-level penalties.
Creating or sharing deepfake pornography without consent is also a felony. Moreover, trafficking a child under 12 or anyone deemed mentally incapacitated is now a capital crime, with violators facing up to life in prison or the death penalty. Individuals depicted in sexual deepfakes without consent can sue for no less than $10,000 in damages. The new laws also increase penalties for cyber-related sexual harassment and child exploitation.
These new laws in Florida aim to protect individuals' privacy and safety, particularly in the digital age. They send a strong message that sexual offenses and child exploitation will not be tolerated and carry severe consequences.
