A federal court in Washington, DC has ruled that Elon Musk holds a continuous and significant role within the executive branch, overruling the White House's claim that he was merely an advisor. This decision enables a high-profile lawsuit brought by 14 US states against Musk, President Donald Trump, and the Department of Government Efficiency (DOGE) to progress.

Led by New Mexico, the states allege that Musk's unauthorized influence over federal reforms, such as budget cuts, agency closures, and regulatory rollbacks, exceeds his legal authority. The suit further asserts that DOGE's actions have resulted in unauthorized access to private systems and sensitive data, all without congressional authorization for formal appointment.

Judge Tanya Chutkan rejected the White House's attempt to characterize Musk's involvement as temporary, finding instead that he exercises substantial power within the executive branch. She acknowledged the states' assertions of potential harm, particularly from alleged data security breaches and overreach by DOGE.

However, the judge agreed to dismiss Trump from the case, citing legal precedent that courts may not block a president's official duties. Rather, she emphasized that the Constitution grants the president broad discretion in appointing officials, even informally.

Musk's role within the department, established during the Trump era, has raised concerns due to his aggressive cost-cutting measures and digitization efforts. Critics Voice Concern over Musk's Initiatives

Musk's initiatives have included dismantling federal IT infrastructure, streamlining bureaucratic systems, and pushing for substantial workforce reductions. These moves have drawn criticism for potentially overstepping legal boundaries.

Musk's political influence has also become a subject of controversy. Despite his significant financial backing of Trump's 2024 campaign, he has recently voiced criticism of the administration's fiscal policy.

In a recent interview with CBS, Musk criticized a $3.8 trillion spending package that narrowly passed the House, warning of potential negative consequences for DOGE's work. "A bill can be big or it can be beautiful, but I don't know if it can be both," he stated.

The legislation, referred to as the "big and beautiful bill" by Trump, aims to extend tax cuts and fund border security while slashing federal programs such as Medicaid. The Congressional Budget Office has forecasted substantial impacts, including the potential loss of health coverage for over eight million Americans.
